It begins with an overview of the course and then moves into the core of the SAFE Act: why Congress enacted a nationwide registration system, how the dual-track framework splits between federal registration (Regulation G for depository institutions) and state licensing (Regulation H for non-depository originators), and the role of the NMLS as the central registry. From there, learners explore the Regulation G definition of a mortgage loan originator — the two-prong test, the activities that trigger registration, and the roles that are excluded. The module introduces the key concepts of federal registration and unique identifiers, preparing learners for deeper application in the next module. By the end of this module, learners will be able to describe the SAFE Act's purpose, distinguish between federal and state tracks, identify who qualifies as an MLO, and explain the foundational elements of federal registration.
  • Institutional Responsibilities, Federal Registration, and Practical Application
    • Building on the foundational knowledge from Module 1, this module shifts focus from individual MLO knowledge to how institutions operationalize SAFE Act compliance in practice. It begins with the organizational duties that Regulation G imposes on federally regulated employers: the written policies and procedures institutions must establish, background check and criminal history requirements, ongoing monitoring of MLO conduct and registration status, and annual independent testing of the compliance program. Learners then explore how these institutional responsibilities are carried out in practice through the NMLS registration process, including unique identifiers and timing requirements, with a focus on correct usage, common errors, and compliance risks. The module then moves to practical application, where a video demonstration shows correct and incorrect NMLS identifier usage across real-world touchpoints, a step-by-step scenario walks through handling a compliance gap, and formative assessments test whether learners can apply their knowledge to realistic situations. By the end of this module, learners will be able to describe institutional compliance obligations and confidently apply registration and identifier requirements in real-world scenarios.
